These Terms of Use govern your access to and use of Second Wind (“the app”). By using the app, you agree to these terms. If you do not agree, please do not use it.

Informational purpose only — not advice

Second Wind is an educational and informational tool. It does not provide financial, tax, legal, investment, or retirement advice, and using it does not create a fiduciary, advisory, or other professional relationship. Always consult CalPERS and qualified professionals before making decisions about your retirement.

Estimates and projections

All calculations are estimates based on the information you provide and on publicly available formulas and data. They may differ materially from your actual CalPERS benefit, tax liability, healthcare costs, or other outcomes. Forward-looking projections — including investment performance, inflation, and legislative changes — are inherently uncertain and are not guarantees of future results.

No warranty

The app is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error-free, uninterrupted, or current.

Limitation of liability

To the maximum extent permitted by law, the app’s creator shall not be liable for any direct, indirect, incidental, consequential, or other damages arising out of or related to your use of, or reliance on, the app or its calculations. You are solely responsible for the decisions you make and should verify all figures independently.

Third-party links

The app contains links to third-party websites and resources. These are provided for convenience only and do not constitute endorsements. We are not responsible for the content, accuracy, or practices of any third-party site.

Acceptable use and intellectual property

You may use Second Wind for your personal, non-commercial retirement planning. The app’s content, design, and code are the property of their creator and may not be copied, resold, or redistributed without permission.

Changes

We may modify the app or these terms at any time. Changes take effect when posted, and the “last updated” date reflects the most recent version. Your continued use of the app constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.
